NOTICE IS HEREBY GIVEN BY THE TOWN OF PATTERSON ZONING BOARD OF APPEALS of a public hearing to be held on Wednesday, May 15, 2024 at 7:00 p.m. at the Patterson Town Hall, 1142 Route 311, Patterson, Putnam County, New York to consider the following applications:
1. Michael and Antonia Rudolph: Case #08-24– Area Variances (Held Over since April 17, 2024): Applicants are requesting two area variances pursuant to Patterson Town Code §154-7 and §154-58, in order to construct an addition to an existing nonconforming dwelling located on a nonconforming lot. Town Code §154-7 restricts lots in the RPL-10 Zoning District to a maximum impervious surface coverage level of 38%. Proposed addition will result in an impervious surface coverage level of 43%; variance requested is for 5%. Town Code §154-58 states that no nonconforming portion of any building may be extended. The existing dwelling is 10.9 ft. from one side property line and 14.9 ft. from the other, making it nonconforming; variance requested is to allow enlargement of a nonconforming structure. This property is located at 326 Lake Shore Drive. Tax Map #25.73-1-23 (RPL-10 Zoning District).
2. Wael Roezik (56 Fairfield Drive, LLC): Case #10-24 – Area Variances: Applicant is requesting two area variances pursuant to Patterson Town Code §154-68.1(B)(2), in order to install a 46 sq. ft. and a 21.2 sq. ft. free standing sign. Town Code §154-68.1(B)(2) allows for a maximum of 25 sq. ft. for freestanding signs. Applicant’s 46 sq. ft. sign will require a variance of 21 sq. ft. in sign area. Town Code §154-68.1(B)(2) also states that only one freestanding sign advertising the use or uses of the premises on which it is located shall be permitted; variance requested is to allow for two freestanding signs on the property. This property is located at 56 Fairfield Drive. Tax Map 36.30-1-8 (GB Zoning District).
3. Joseph Plaskett, Jr.: Case #11-24 – Special Use Permit –Accessory Residential Building & Area Variances: Applicant is requesting to obtain a special use permit and two area variances pursuant to §154-106 of the Patterson Town Code to legalize an existing accessory building with a three-car garage below. Patterson Town Code §154-106 requires applicants to obtain a special use permit in order to construct an accessory building for residential occupancy. Town Code §154-106(D) limits the garage space of accessory buildings to a maximum of 500 sq. ft. Existing garage is 972 sq. ft.; variance requested is for 472 sq. ft. Town Code §154-106(H) limits the height of accessory buildings to a maximum of 80% of the height of the principal dwelling. Existing principal dwelling is 26 ft.in height and existing garage is 21 ft. in height; variance requested is for.5 ft. in height over the 20.5 ft. permitted. This property is located at 938 Route 311. Tax Map 13.7-1-35 (R-1 Zoning District).
