Supervisor Griffin called the Patterson Town Board meeting to order at 7:30 p.m. with 9 in attendance.

 

AUDIT OF BILLS

 

Mrs. Nacerino made a motion to approve the following bills chargeable to 2008:

KEEP PUTNAM BEAUTIFUL PRESENTATION

 

Mr. Walt Thompson stated thank you for having me.  I heard on the way over that if you can remember a sequence of seven numbers you are mentally in good shape.  A little later I am going to ask you, but right now the numbers are two, two, five, four, three, zero, zero.

 

My name is Walt Thompson with Keep Putnam Beautiful and I appreciate you having me here tonight to talk about some of the things we are doing to keep Putnam beautiful.  The leadership of your Supervisor, Michael Griffin and County Executive Bob Bondi, County Legislature and Keep Putnam Beautiful works to improve the quality of life for all of our residents (inaudible) in Putnam County. Adopt-A-Highway has some signs around the area; those are free if you would like to adopt a road.  We just ask that you do a clean up three or four times a year.  A question that is often asked is who puts the signs in and the answer is the DOT or someone from the County or the Town.  It depends on which road you will put the sign on.  Frogs recently filled out an application to adopt on Route 22, Front Street and somewhere else.  The signs for the County and Town roads are made at the Highway Department on Fair Street.  The DOT signs are made by the prisoners at the Fishkill Correctional Facility.  You might be interested to know that there is thirty-eight adopt-a-highway and twenty-seven adopt-a-road signs in Putnam County.  That is the largest number in New York State.  We are also working with schools.  Carmel Future Business Leaders of America and Brewster Globe Club.  The Brewster Globe Club has adopted a campus and we give them a sign and (inaudible).

All our projects at Keep Putnam Beautiful are funded by donations, grants and sponsorships.  There is no taxpayer money involved with any of the projects we do.  I would like to ask the Town Board if you would consider changing your litter law penalties.  Not the law itself but the penalties.  As I go from Town to Town, most Town’s do have in their litter regulations a penalty.  What I am suggesting is that we insert the word mandatory.  I live in Putnam Valley and I sat through more than one court appearance where the person who has dumped a lot of litter gets slapped with two hours of community service.  If I could give you this outline that would change the law.  It reads:  To reduce litter and allow judges to levy more substantial penalties residents of Patterson would like the litter law penalty to read a fine up to one thousand dollars with a mandatory minimum of two hundred fifty dollars and twelve hours of community service cleaning up litter coupled with a surcharge of seven hundred and fifty dollars for special circumstances.  You have an umbrella of one thousand dollars and of that, two hundred fifty is mandatory.  It is somewhat similar to when you get a traffic ticket you have a certain amount you have to pay and there is an optional surcharge.  Many times the judges will wave the surcharge for whatever reasons.  I am suggesting special circumstances would improve more than one cubic foot of litter or trash deposited in one place at one time.  A seconded or higher number of littering offense is in a twelve-month period.  Third special circumstance would be depositing construction demolition roofing debris and that sort of thing.  The fourth would be television, computers and electronic devices.  This would allow the judges some leeway in that it could not give the surcharge. 

 

Mr. Kassay stated we will give it to our Town Clerk, Antoinette Kopeck.

 

Mr. Thompson stated I understand later on someone is going to be talking about clean up day here in Patterson.

 

Mr. O’Connor stated we will be doing it for a couple of days.

 

Mr. Thompson asked if anyone has questions and asked if anyone remembered the number he gave them in the beginning of his speech.

 

Audience member stated two two five four three zero zero.

 

Mr. Thompson stated yes.  Any time you see anyone littering remember that number and call it to report that person littering.  That is the direct number to the Sheriff’s Department.  Sheriff Don Smith has been terrifically supportive.  He has developed a letter that will go directly to the registered owner of that vehicle.  It is not a fine or a violation it is just a letter that will go out to the owner.  It basically states that the registered owner of the vehicle was seen on March 15 throwing a cigarette butt at McDonalds out of the window or whatever the case may be.  Sheriff Smith says that is not the way we want to conduct ourselves in this area so please don’t do it.  The final paragraph states if you think you got this letter by mistake please let us know.  Over seventy-three letters have been sent out and no one has called back to say that it is not them.  What has happened is that the registered owner of the vehicle is sometimes the parent of the driver and we are encouraging a discussion of some sort to happen when that letter comes in.

 

Mr. Thompson stated I appreciate your support and asked if the Board would look into the litter law penalty change that I think would help.  The biggest thing we could do is enforcement and setting a good example.

 

Mr. O’Connor stated if you do call the number Mr. Thompson gave us, you are not making a formal complaint so your name is not registered.  The person cannot request a FOIL and ask who complained about them.  It would not come back to you.

ADVERTISE FOR PUBLIC HEARING-BLASTING LAW

 

Mr. Kassay made a motion to authorize the Town Clerk to advertise the Public Hearing for the Blasting and Explosives Law on April 9, 2008 at 7:30 p.m. at Town Hall before the actual Town Board meeting.

 

Mr. Kassay introduced the following Resolution INTRODUCING LOCAL LAW I-2 AND PROVIDING FOR PUBLIC NOTICE AND HEARING:

BE IT RESOLVED that the enactment of Chapter 58 of the Patterson Town Code, entitled, “BLASTING AND EXPLOSIVES,” which Chapter will establish regulations regarding blasting and the use of explosives within the Town of Patterson, is hereby introduced by Councilman Kassay, as Introductory Local Law #I-2 of the year 2008 before the Town Board of the Town of Patterson in the County of Putnam and State of New York, and

 

BE IT FURTHER RESOLVED, that copies of the aforesaid proposed Chapter, which is attached hereto, be laid upon the desk of each member of the Board, and

 

BE IT FURTHER RESOLVED, that the Town Board will hold a public hearing on said proposed Chapter at the Town Hall, in the Town of Patterson, New York at 7:30 o'clock P.M. on April 9, 2008, and

 

BE IT FURTHER RESOLVED, that the Clerk publish or cause to be published a public notice in the official newspaper of the Town of Patterson of said public hearing at least five (5) days prior thereto.

PATTERSON LITTLE LEAGUE LETTER - MARCH 12, 2008

 

Mr. Kassay stated I received a Patterson Little League Letter of March 12, 2008 addressed to the Supervisor, Mr. Michael Griffin, stating that they would like to extend an invitation to the entire Town Board to attend opening day ceremonies on Saturday, April 12, 2008.  They will start between 12:30 p.m. and 12:45 p.m.  They would like to introduce the Supervisor and the Town Board prior to the introduction of team members.  Families and teams will begin arriving and assembling around 11:30 a.m. 

 

Mr. Kassay stated we should arrive around any time prior to 12:30 p.m.  I know I will be attending and I hope the rest of the Board will be attending.

 

Mr. Griffin and Mrs. Nacerino stated they will attend.

 

LITTERING

 

Mr. Kassay stated if you are going to call the 225-4300 to report that someone is littering please pull off to the side of the road or make sure you use your hands free cell phone when reporting to the Sheriff’s Department.  

 

Mr. Kassay asked Mrs. Kopeck to make copies of the Putnam County Littering Report Form for anyone who is interested in seeing the form.

 

Mr. Thompson stated that form is an internal document in the Sheriff’s Department.  They are not suggesting that these be distributed, although it is fine if you do.   These are what the dispatcher will be filling out when they receive a call.  It is not a public

document.

 

Mr. Griffin stated at least they will know what they are looking for when they are out there looking for people who are littering.

 

Mr. Kassay stated now it is a public document since we are discussing it here.  This will be like a guideline so they will know what is going to be asked of them.

 

AWARD PORTABLE TOILET BID

 

Mr. Kassay introduced the following Resolution to AWARD BID FOR PORTABLE RESTROOM SERVICE:

WHEREAS, the Town Board of the Town of Patterson recently advertised for bids for portable restroom service for Club Court Park and Cornwall Field, and

 

WHEREAS, bids were received from two portable refuse companies, and

 

WHEREAS, Royal Flush submitted the lowest qualified bid to provide one (1) Handicap serviced once a week for the sum of $135.00 per  month at Club Court Park, and one(1)

Handicap serviced twice a week for the sum of $175.00 per month and one (1) Standard

serviced twice a week for $110.00 per month at Cornwall Field., and

 

WHEREAS, the Town Board of the Town of Patterson wishes to accept the bid of Royal Flush to provide portable restroom service;

 

NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Patterson hereby  accepts the bid of Royal Flush to provide portable restroom as stated above in accordance with the statement attached hereto, and

 

BE IT FURTHER RESOLVED, that the Town Board of the Town of Patterson hereby authorizes the Supervisor to execute any and all documents necessary to give effect to this resolution.

LETTER OF MARCH 12, 2008 – 633 FAIR STREET

 

Mr. Kassay stated many times employees will do something above and beyond what they are required to do.  This particular letter was written to the Supervisor regarding the Sanitation Department.  The letter is from Mr. Lawrence McFarland, 633 Fair Street who took the time out to write this letter:

 

Dear Mr. Griffin,

 

Garbage along Fair Street is picked up early on Monday mornings.  We usually leave ours on our Patterson brick pillar sometime Sunday and move the bag across the street with neighbors stuff to be picked up Monday morning eliminating one pick-up.  Monday we were late getting down to the end of the driveway and saw no garbage at our neighbor’s houses.  Don, I thought missed the pick-up then I turned and noticed our garbage was gone too.  I assumed the pick-up crew saw our bag on the Patterson pillar and came across the street to collect it.  Please relay our thanks to them.

 

Mr. Kassay stated I will let the fellows at the Sanitation Department know that what they did was certainly appreciated by one of the residents in the Town.  I thought this was worth mentioning.

PATTERSON SANITATION AND RECYCLING

 

Mr. Kassay stated our Coordinator Frank Farrell, Garbage District #1, #2 and Recycling said that we could be registered with the County for a Waste Hauler Certificate of Registration.  We are registered with the department under the provisions of Local Law  #10 and #11 Waste Hauler Collection and Transportation of Offensives.  They gave us six stickers to put on all of the sanitation and recycling vehicles.  They are only good for one year.  They will expire December 31, 2008.  It states, as a reminder in the future at the discretion of the Department of Health arrangements may be made for an inspection of your vehicles.  Please note the following items will be inspected; the vehicle containers prevent the loss or discharge of offensive material during transportation; the identification of the owner of the vehicle or the business name and address is clearly posted on both sides of the vehicle; permit sticker is to be displayed prominently on each registered vehicle.  This is something new that has been instituted.  The sticker states Putnam County Department of Health and Environmental Health Services Waste Hauler Permit with the year and when it expires.

 

EXECUTIVE SESSION

 

Mr. Kassay stated he will defer his Executive Session – Personnel to the end of the meeting.

 

GINNY NACERINO

 

ECONOMIC DEVELOPMENT – CONFERENCE

 

Mrs. Nacerino stated on Monday, March 24, 2008 I along with Mr. Joe Capasso, Councilman attended an Economic Development meeting in Carmel.  This meeting consisted of Supervisors and Town Board members from every municipality in Putnam County along with several Legislators hosted by Kevin Bailey, President of the Putnam County Economic Development Corporation and Bert Houseworth, CEO Putnam County Industrial Development Agency.  The purpose of the meeting was to bring all interested parties in Town Government together to support and try to develop smart economic development and to try to brainstorm and bring together effective measures to do so.  The mission of the IDA is to retain the present Industrial Tax base in Putnam County and help to attract a clean environmentally sense of manufactured and industrial interest to the County.  I think the one thing that was derived from that meeting is that everyone there had a vested interest in brining smart economic development to the County and we were all very cognizant that we certainly want to take into consideration the environment and all the factors including the mandates that may be a problem to development or may be an asset to development.  We will continue to meet but the next date has not been determined.  Mr. Capasso do you have anything to say.

 

Mr. Capasso stated they are looking for the Towns to offer sites for development so it could be shoveled ready.  That means we go through the process of what the planner wants and what the Town wants to see in the Town on certain sites.  In other words, if we have fourteen acres and we would like to see a department store there we get it ready for a developer to come in.  That is what they are looking for.  They are looking for a five year plan to be set up so we have all our commercial and industrial sites ready for developers prior to coming and going to this Board and that and getting frustrated.  That is what this is all about.  Mr. Capasso told Mr. Rich Williams, Town Planner he does have to get involved.

 

Mr. Williams stated whatever you want to do.

 

Mr. Capasso stated I feel we need some development for our Town.  We don’t want to discourage anyone with postponing it for two years just like Patterson Crossing.

 

Mr. Williams stated we have been waiting on that……..

Mr. Capasso stated if it was discussed ahead of time and permits had gone through to the developer, it wouldn’t be so delayed.  We desperately need it.  We are being taxed out of this County.

 

Mrs. Nacerino stated it is still in the beginning stages and I think that is a concept that may or may not be able to be developed.  As I pointed out at the meeting, shoveled ready concept does have its draw backs and there are many loop holes and questions that need to be answered and I think that was the purpose of all the Town Officials and County Officials coming together for that very reason.  The shovel ready concept may be able to work but there are a lot of factors that might prevent it from working.  It is a meeting of the minds, we all have to share the common thread, and we do feel that we need smart economic development to off set our tax base.  How we get there is yet to be determined.

 

Mr. Capasso stated but we need to go forward.  We need to do something.

 

Mrs. Nacerino stated just by virtue of the fact that we have attempted to meet we are moving forward.

 

LIBRARY MEETING RECAP

 

Mrs. Nacerino stated on March 18, 2008 as the liaison to the Patterson Library I attended their monthly Board meeting.  It was very informational and they were very appreciative that I was present to answer some of their questions on behalf of the Town specifically the Court House process.  I was able to give them a general forecast but we will not know anything more until April 4, 2008 when the attorney’s do have the opportunity to meet and I will follow up and attend their April 15, 2008 meeting.

 

WIND FARM SEMINAR

 

Mrs. Nacerino stated I have a request from the Town Planner.  We are currently evaluating the potential to address the Towns municipal energy needs using alternate forms of energy such as wind.  There is a three-day conference on using wind energy being given in Albany April 14 - 16, 2008.  After reviewing the schedule attendance at the conference session offered on April 14, 2008 would be beneficial to the Town.  I would like to request that myself and the Town Supervisor or his designee be allowed to attend the April 14, 2008 session for a cost not to exceed $300.00.

 

Mrs. Nacerino stated I think exploring any possibility to save energy and alternate sources of energy is certainly beneficial.  I applaud Mr. Williams for taking a proactive stand on trying to seek more information on this. 

 

Mrs. Nacerino made a motion to approve the cost not to exceed $300.00 for two people to attend this conference in Albany on April 14, 2008.

 

Mr. Kassay stated this is for only one day.

MICHAEL GRIFFIN

 

TOWN PLANNER’S MEMO – TRACTOR SUPPLY

 

Mr. Griffin stated I have received a letter from the Town Planner.  Please find enclosed a copy of State Environmental Quality Review Act (SEQRA) Lead Agency Notice.  Full Environmental Assessment Form (EAF) Parts one and two, Site Plan and application materials submitted to the Patterson Planning Board by Tojant Incorporation hereafter

referred to as applicant.  It would be helpful to the Planning Board if you would provide any comments on the project and/or identify other issues, which warrant evaluation during the environmental review process within the next thirty days.  Has anyone had a chance to review the project.  My only comment would be to focus on architecture so we get a project out there.  You have thirty days from March 18, 2008.

 

Mr. Griffin made a motion to authorize the Patterson Planning Board to act as lead agency for the Tractor Supply project.

 

Seconded by Mrs. Nacerino.  All In Favor: Aye.  Carried.

 

MACRIS LETTER

 

Mr. Griffin stated Mrs. Macris is under water on Addison Road.  Once again I sent a certified letter to the Mattas and once again we received a response back that they are going to get the Humane Society of the United States to come and take another look at the problem and see if they can put in another set of beaver bafflers considering three times they haven’t been able to baffle the beavers.  They continually refuse to allow the Town permission to go on the property for the purposes of trapping.  That is where we stand.

 

Mr. O’Connor stated if I do something on my property that causes flooding to my neighbor’s property there would be recourse.

 

Mrs. Nacerino stated are they liable.

 

Mr. O’Connor stated if they allowed the beavers to do what they cannot do themselves, are they liable.

 

Mr. Griffin stated I don’t believe that is the case.  If they built a dam I think there would be recourse but the fact that nature put the dam there they do not have recourse.  We went through this with a Town road.  Every time we got a couple of inches of rain, Addison Drive is under water.  Until the Mattas agree to allow us to do what needs to be done, I don’t see any significant improvement with the problem.  The water level is probably three feet higher then it should be and the beaver bafflers were put in to allow about eight to ten inches of water reduction in the levels.  It is not going to get their septic system out of the water, it is not going to help their swimming pool and it’s sinking in the one corner because the ground has been perpetually wet for three years.  I don’t know what to offer the homeowners at this point.

 

Mr. O’Connor stated I think there is a difference between acknowledging an act of nature such as rain but to make a conscientious decision not to stop a creature from doing damage to your neighbor’s property is absurd.

 

Ms. Jennifer Herodes stated it doesn’t equate to liability.  I agree with Mike’s analysis of it, you will never hold them liable for refusing to allow people to come in to trap the beavers.

 

Mr. O’Connor stated then let them think of another way to stop the damage from happening.

 

Ms. Herodes stated that is a different point, but as far as trying to hold them liable we can’t.

 

Mr. Griffin stated the Humane Society came out and put a little hole in the dam along with a couple of plastic pipes through the dam, they put a cage in the water and three weeks later the beaver built a dam in front of the two pipes which raised the water right back up.  They put another set of pipes in and the beaver built another dam in front of that

one.  Either we have an extraordinarily intelligent beaver here in Patterson or people who came up with the beaver baffler are kidding themselves because frankly it does not work. 

 

Mr. Griffin asked Mr. O’Connor if he would like to compose a letter to the Mattas, he will be more then happy to type it up for him.

 

Mr. O’Connor stated there is nothing we can do.  This concept that the Mattas are not part of nature and do not deserve protection and the beaver is part of nature and does deserve protection borders on lunacy.

 

WWTP UPDATE

 

Mr. Griffin stated after eleven years the Waste Water Treatment Plant is now operational and there is sewage going to the plant and as of today, we tied in Front Street to Carmel Central Schools and Covington Greens.  So far so good.  Everything is working exactly as it was designed and the water coming out the other end will be clear and also well water quality.

 

PCAP-REQUEST

 

Mr. Griffin stated Putnam Community Action Program celebrates its twenty-second annual fundraising luncheon and they have asked us if we would like to buy some tickets.  If someone would like to go and represent the Town, it is only thirty dollars per person.  It is Thursday April 3, 2008 at noon to 1:30 p.m. at St. James Church, Doughty Hall, Glenida Avenue, Carmel, New York.  Please see me if you would like to attend.

 

AUDUBON INTERNATIONAL - DISCUSSION

 

Mr. Griffin stated we received a letter from the Audubon International Society; 

 

Dear Community Leader:

 

They have an opportunity to meet with many at the Seventy-Fifth Annual Association of Town’s.  They were very excited and ties right in with Economic Development and is helping people help the environment.  Their mission is to provide people with education assistance and to not cripple the economy.  If anyone would like information on how to join or to do a seminar here, they would be more than happy to do that.

 

Mrs. Nacerino stated I think that would be something we should explore.

 

Mr. Griffin stated I can invite them here or we can join whatever you would like to do.

 

Mrs. Nacerino stated I think that aligns with our philosophy.

 

Mr. Griffin stated I agree.

 

EDMOND O’CONNOR

 

AWARD LAWN MOWING BID

 

Mr. O’Connor stated we received two bids that were very close.  The law states that we have the right to select the bid proposal that would be in the best interest of the municipality.  There is a less than two percent difference between the two.  I think Colonial Town Landscaping would be the best for the Town, which is almost two percent higher.  Based on all the specifications from Pine Hill, I’m sure they are fine people; they do mostly residential in Ulster County and Connecticut.  Their commercial experience is only small properties in Westchester.  They do a summer camp in Dutchess and another one in Ulster.  Their references are a restaurant in Putnam Valley and a residence in Ellenville.  They do have equipment.  Colonial Town has twenty years experience in this

area.  They have familiarity with our specific properties that need work.  They have a great proven record of accomplishment and wonderful list of equipment.  They are housed locally.  Their references are the Town of Southeast, the Hudson Valley Trust that is in Patterson and the Highway Rehab in Brewster and of course the Town of Patterson.  We can attest to their dedication and skill to what they do.  In my opinion, we should exercise our right to accept their bid proposal that best meets the interest of the municipality of Patterson, which would be Colonial Town Landscaping.

 

Mr. O’Connor introduced the following Resolution ACCEPTANCE OF BID FOR SEASONAL 2008 LAWN MAINTENANCE SERVICES:

WHEREAS, the Town Board of the Town of Patterson has duly advertised for Bids for lawn maintenance services, including but not limited to cutting and bagging, within the Town of Patterson for the 2008 season, which will begin on May 11, 2008 and continue through November 30, 2008, and

                       

WHEREAS, two bids were received for the items that were advertised, and

                       

WHEREAS, COLONIALTOWN LANDSCAPING LLC, 735 Route 311, P.O. Box 42, Patterson, New York 12563 has submitted the lowest responsible bid to perform lawn maintenance services, including but not limited to cutting and bagging, within the Town of Patterson for the 2008 season, which will begin on May 11, 2008 and continue through November 30, 2008 for the sum not to exceed Twenty Three Thousand Two Hundred Seventy Five ($23,275.00) Dollars, and

                       

WHEREAS, COLONIALTOWN LANDSCAPING LLC is the only bidder that met all specifications of the bid requirements, and 

                       

WHEREAS, the  Town  Board  of  the Town of Patterson wishes to accept the bid submitted by COLONIALTOWN LANDSCAPING LLC;

                       

NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Patterson hereby accepts the bid of COLONIALTOWN LANDSCAPING LLC to perform lawn maintenance services, including but not limited to cutting and bagging, within the Town of Patterson for the 2008 season, which will begin on May 11, 2008 and continue through November 30, 2008 for the sum not to exceed Twenty Three  Thousand Two Hundred Seventy Five ($23,275.00) Dollars, in accordance with the specifications and bid proposal with respect thereto, and

                       

BE IT FURTHER RESOLVED, that the Town Board of the Town of Patterson hereby authorizes the Supervisor to execute any and all documents necessary to give effect to this resolution.

 

Mr. Kassay stated you did advertise this on March 12, 2008 and I notice that the second bidder did not provide us with a home improvement license.

 

Mr. O’Connor stated I was going to bring that up, but he does have a number and he stated it was to late to get the form into the mail to us.  You could claim he did not meet the specific specification of having the license in hand.

 

Mr. Kassay stated if you look at the application for registration as a home improvement contractor, it says the start date is March 21, 2010 and it ends March 31, 2010.

 

Mr. O’Connor stated we can add to it he does not meet specifications.

 

Mr. Kassay stated it is not valid.

TOWN CLEAN-UP DAYS

 

Mr. O’Connor stated we heard from Mr. Thompson on being proactive in stopping people from littering.  I have already spoken with some organizations; the PLCC will be having a meeting regarding this matter. For Patterson’s Spring Clean Up we will be doing two weekends this year.  This will be beneficial for those people who cannot make it one weekend; they will have an option of two weekends.  It is almost like a preapproved rain date.  The dates are Saturday, April 26, 2008 and Saturday May 3, 2008.  Help keep Patterson as beautiful as nature made it.  Join your neighbors in removing litter in front of your property.  Join with groups for area clean ups.  Bags will be available at Town Hall on Friday, April 25, 2008 and on Friday, May 2, 2008 from 10:00 a.m. for 4:00 p.m.  Bags will then be handed out on clean up day from 7:00 a.m. to noon at the Patterson Library and the Putnam Lake Fire Department.  Please fill trash bags and leave it on the corners or in front of your house and they will be picked up.  For more information call Patterson Town Hall at 878-6500 for Councilwoman Nacerino or myself.  THIS IS NOT A BULK PICKUP.  This year we are going to make a big deal out it.  If anyone has specific ideas or knows of a group that we could contact to help us please let me know.

 

Mr. Kassay stated what color are the bags going to be.

 

Mr. O’Connor stated orange.  I went to Home Depot and Costco and they only had white or black.

 

Mr. Kassay stated if the people are going to clean up in front of their house District #1 private sanitation will be picking that up.  Is sanitation in District #2 picking up.

 

Mr. O’Connor stated if they leave it in front of their house sanitation will pick it up.

We will get the odd bags picked up also. 

 

MILLER BOND

 

Mr. O’Connor made a motion to release the bond as soon as we receive official documentation saying they will not be moving ahead without the construction planned.

OTHER BUSINESS

 

EDMOND O’CONNOR

 

Mr. O’Connor stated I neglected to put on my agenda that Mr. Andrew DeStefano has a problem with site lines in his development across the street.  I drove over there to see for myself and it appears there is a problem.

 

Mr. DeStefano stated in the Dorset Hollow subdivision we have West Street, Jill Court and Bonnie Court.  West Street not only runs north and south, you can make a left, and it still stays as West Street all the way to the school.  It is a thirty-one home subdivision.  What has happened is that the entire Mathew Paterson School, and I don’t blame them, uses Dorset Hollow to get to school.  On South Street, you have twenty-five buses and four stop signs and the entire route is bumper to bumper.  So they take Dorset Hollow as a short cut.  You see them in the morning driving to work like nuts because they are late for work right through Dorset Hollow fifty or sixty miles an hour.  You have hundreds of people driving through every day.  In addition to that, add in twenty women a day that belong to a walking club despite the fact that we have beautiful sidewalks but they have decided that they have to use the street.  I don’t know why.  My other favorite is that

Dutchess Driving School has decided a subdivision is a nice place to teach people how to drive.  When you come out of my subdivision the problem seems to be an engineering problem.  When you leave Jill Court and you come to West Street and you want to make a right hand turn toward Route 311, and you look to your left all you can see basically is about a car maybe a car and a half length of street and then it dips very sharply down.  You do not see anything coming.

 

Mr. O’Connor stated there is also a stop sign on Jill Court to make a right.  It is a combination of the dip and also there is a high stone fence. 

 

Mr. DeStefano stated my wife and I almost had a collision together.   She was turning and I was going straight and we almost crashed.  You can’t see.  I’m afraid that when people are coming through there people are not really paying attention.  I know so I really pay attention.  We are asking if someone could come and take a look and consider a stop sign.

 

Mrs. Nacerino stated I think a letter should be sent to the Supervisor of Transportation of the Carmel Central School District advising them that they are using your subdivision as an alternate route.  They do approve the routes before hand and that might be something the Supervisor isn’t aware of.

 

Mr. DeStefano stated the buses aren’t doing it.

 

Mrs. Nacerino stated I know it is a separate issue; however, it is an issue that needs to be addressed.  I think the only way to advise it is to advise the Supervisor of Transportation at the Carmel Central School District.

 

Mr. DeStefano stated it is mostly parents and people late for work.

 

Mrs. Nacerino stated it only intensifies the potential for an accident to occur so you want to deter that as well.

 

Mr. DeStefano stated if it was just thirty-one homes and visitors, I wouldn’t bring it up but it’s the school that is at fault.

 

Mr. Kassay stated the Highway Superintendent should be notified as well.  We should have him go out and do a site inspection.

 

Mr. O’Connor stated I think the answer would be to put in a stop sign.

 

Mr. Kassay stated a stop sign under those conditions might be dangerous.  If they are not looking at the sign before the base of the hill warning that there is a stop sign up there and they come flying up over the top of that hill and somebody is stopped because there is only a car and a half length to stop, we could be causing more of a problem.  Again, the Highway Superintendent should be notified and he can do an evaluation.

 

Mrs. Nacerino stated could you do a speed bump.

 

Mr. O’Connor stated no.

 

Mr. Kassay stated you could lose control of your vehicle if you are going fifty miles per hour and all of a sudden you come upon a speed bump you will be in a lot of trouble.

 

Mr. Griffin asked Mr. DeStefano what time in the morning does this occur.

 

Mr. DeStefano stated it starts around 8:30 a.m. and continues until around 10:00 a.m.

 

Mr. Griffin stated when we get in touch with the Sheriffs Department I will give him the times this is happening.

Mr. O’Connor stated this is happening only in the morning.

 

Mr. DeStefano stated no, it is also happening in the afternoon.  It is pretty much throughout the day.

 

Mr. Kassay stated you could have a sign that would restrict the times you can make a right onto Dorset Hollow.  In other words, no through traffic between 7:00 a.m. and 9:00 a.m.

 

Mr. DeStefano stated with something simple like that, people get confused.

 

Mr. Griffin stated how do you think the residents would feel about a three way stop sign there.

 

Mr. DeStefano stated everyone has young children so I think they would be in favor of it.

 

Mr. Griffin stated there is a problem and it’s the only way you are going to slow people down.

 

Mr. DeStefano thanked the Town Board.

 

MICHAEL GRIFFIN

 

Mr. Griffin stated I drafted up a letter that the Town Board asked me to do regarding Article X Public Service Law.  I put it in your mailboxes.  Time is of the essence so I would need your comments by early next week.

 

PUBLIC RECOGNITION

 

Mr. Robert O’Dell asked Mr. Kassay regarding recycling and sanitation getting a sticker, does that only apply to new installed trucks.

Mr. Kassay stated yes.

 

Mr. O’Dell stated not the privately owned.

 

Mr. Kassay stated only municipally owned.

 

Mr. O’Dell stated why would you have to get it inspected when I don’t have to be inspected.

 

Mr. Kassay stated the Department of Health requires it.  Private contractors have to deal with it in a different way.  Federal guidelines probably addresses it, I’m not sure.

 

Mr. O’Dell stated maybe, but personally, I don’t need anyone’s guidelines.

 

Mr. Kassay stated you can put things in your truck and leak it on the roadway but you are a private taxpayer.  What they are addressing is a municipality.   That law does not address a private citizen.
